Rule 3.1205 Filing and presentation of the ex parte application

When someone files an emergency court request (called an ex parte application), the court clerk must accept it and pass it along to a judge. This is true even if the person filing did not follow all the required steps, like giving proper notice to the other side.

This rule protects people from having their emergency request thrown out on a technicality at the front desk. The judge, not the clerk, gets to decide whether the request should be granted or denied.
