Rule 3.1322 Motions to strike

When someone wants to ask the court to remove part of a filing from the other side, they must follow specific rules about what to include in their request. If they want to remove specific sentences or phrases, they have to copy those exact words in their request. If they want to remove a whole paragraph or legal claim, they do not need to copy it out. Each item they want removed must be listed and numbered in order.

There are also strict deadlines for when this request must be filed. It must be submitted within the same time window that the person has to respond to the other side's filing. If the person is also filing a demurrer (a legal challenge saying the filing has a legal flaw), the motion to strike must be filed at the same time. Both requests will then be heard by the judge together on the same day.
