Rule 3.923 Selection and qualification of referee

When a judge decides to send a case to a referee, the court picks that referee following the rules in California's Code of Civil Procedure, section 640.

If the referee is a former California judge, that person must also be a member of the California State Bar, either active or inactive. This means a retired judge cannot serve as a referee unless they hold bar membership.
