This rule makes clear that two other laws still apply, even when other privacy protections might otherwise block access to medical or mental health records.

If you are in a case where Section 996 or 1016 already allows someone to see your medical or psychological records, this rule does not change that. Those sections cover situations like when a patient puts their own mental or physical condition at issue in a lawsuit, or when a doctor's advice is part of a legal claim.

In short, this rule does not take away any access to records that was already allowed under those other laws.
