When someone dies and their family sues for wrongful death, the person who died cannot testify in court. But things the deceased person said while they were alive can still be used as evidence.

This rule allows the other side in a wrongful death lawsuit to use those statements against the family members who are suing. Normally, statements made outside of court cannot be used as evidence because of the hearsay rule. This rule creates an exception so those statements can be admitted.
