When a lawyer is in court or any other setting where someone tries to get a protected communication revealed, the lawyer must speak up and assert the privilege to block that disclosure. The lawyer cannot stay silent and let the communication come out.

This only applies when the lawyer is actually present at the proceeding and has the legal authority to claim the privilege on behalf of the client. If both conditions are met, claiming the privilege is not optional for the lawyer. It is required.
