In a criminal case, a spouse who is the defendant can choose to use private conversations with their husband or wife as evidence. The normal rule that protects private talks between married people does not apply in this situation.

This only works when the defendant is one of the two people who actually had the conversation. If you are on trial and a private talk with your spouse could help your case, you have the right to share it in court.
