Courts of Appeal with more than one division
Rules Relating to the Supreme Court and Courts of Appeal
Appeals and original proceedings filed in a Court of Appeal with more than one division, or transferred to such a court without designation of a division, may be assigned to divisions in a way that will equalize the distribution of business among them. The clerk/executive officer of the Court of Appeal must keep records showing the divisions in which cases and proceedings are pending.
Some California Courts of Appeal are large enough to have multiple divisions. When a case is filed or transferred to one of these courts without being sent to a specific division, the court can assign it to whichever division helps balance the workload evenly across all divisions.
The clerk of the court keeps track of which cases are assigned to which division. This recordkeeping helps the court manage its caseload and makes sure no single division gets overloaded with cases.
