Rule 7.454 Ex parte application for order authorizing sale of securities or other personal property

If someone in charge of an estate wants to sell or turn over personal property, they may need to ask the court for permission. To do this, they file a special request called an ex parte application, which means they are asking the court without a full hearing.

The request must say whether the property was left to a specific person in the will. For example, if a will says "I leave my stock portfolio to my nephew," that is a specific devise. If the property was left to a named person this way, that person must give written consent before the sale or transfer can happen. The consent form must be filed with the court.
