Rule 39 Trial by Jury or by the Court

This rule has no content in the Delaware Court of Chancery. That is because the Court of Chancery does not hold jury trials. All cases in this court are decided by a judge alone.

If you need a jury trial, you would need to file your case in a different court, such as the Delaware Superior Court.
