Rule 1103 Effective Date

The Delaware Rules of Evidence became official on July 1, 1980. Any court case that started after that date must follow these rules.

For cases that were already in progress when the rules took effect, the new rules also apply to any steps taken in those cases after July 1, 1980. However, if using the new rules in an older case would cause unfairness or simply would not work, the court can fall back on the older rules that existed before 1980.
