Rule 128 Summary judgment

In Delaware's Summary Proceedings, neither side can ask the court to decide the case early based on written arguments and evidence alone. This type of request, called a summary judgment motion, is not allowed in these cases.

Summary Proceedings are designed to move quickly through the court system. Skipping straight to a decision without a full hearing is not an option here, so both sides will need to present their case the normal way.
