Rule 8 Questions which may be raised on appeal

If you want to raise an issue on appeal, you must have brought that same issue up during the original trial. The appeals court will generally only look at problems you already pointed out to the lower court.

There is an exception to this rule. If fairness requires it, the appeals court can choose to consider a new issue even if it was never raised at trial. This does not happen often, but the court has the power to do it when justice calls for it.
