Rule 43 Substitution of parties.

If someone involved in an appeal dies while the case is still going on, the case does not just end. The court will decide how the case should move forward, even without that person. This means the death of a party does not automatically stop or cancel the appeal.

If a public official is part of the case in their official role, and that person dies, quits, or leaves office while the appeal is pending, the case still continues. Whoever takes over that job automatically steps into the case in their place. No special request is needed to make this happen.

The court can officially record this change of parties at any point, even later on. But if the court never gets around to writing an official order about the switch, it does not matter. The substitution still counts as valid, whether or not there is paperwork confirming it.
