Rule 32.10 Appeal.

If you or the state loses a case involving a post-conviction petition (this is the process where someone challenges their conviction or sentence after the original trial is over), either side can appeal the decision. If the case was in circuit court, the appeal goes to the Alabama Court of Criminal Appeals, and you have to follow the normal appeal deadlines and steps under the Alabama Rules of Appellate Procedure. If the case was in district or municipal court, you follow whatever appeal process already applies there.

While the appeal is going on, the person who filed the petition cannot be released on bond. They stay in custody during this time no matter which side is appealing.

If the court eventually orders a new trial and that order becomes final, or if the deadline to appeal that order passes without anyone appealing, then the normal bond rules kick in. At that point, the person is treated like someone waiting for a first trial, and the usual rules for granting bond before trial apply.
