When you file a small claims case in Alabama, the other side (called the defendant) has to be formally notified about the lawsuit. This notification process is called "service of process." It's how the court makes sure the defendant knows they're being sued and has a chance to respond.
For small claims cases, the rules don't set up a special or simplified way to notify defendants. Instead, you follow the same notification rules used in regular civil court cases across Alabama. This means things like having someone officially deliver the court papers to the defendant, or using certified mail, following the standard methods spelled out in Alabama's civil procedure rules.
In practical terms, this means small claims court doesn't cut corners on this step. Even though small claims cases are meant to be simpler and faster than regular lawsuits, you still have to properly notify the person you're suing using the same legal standards as any other case.
