Rule 118 Punishment
Rule Text
It is within the sound discretion of the Court to impose a penalty, either fine or imprisonment, for contempt reasonably commensurate with the gravity of the offense. If there is an express finding that the accused has the present ability to perform an act ordered, that the punishment may be imprisonment until the act has been performed. However, the commitment of such a contemnor must be reviewed periodically and if the Court finds that the contemnor no longer has the ability to comply then the contemnor must be released. At the discretion of the Court, if there is a finding of contempt, monetary sanctions may be awarded for the costs, including reasonable attorney fees, of bringing the proceeding.
