Rule 25 Procedure After a Verdict or Finding of Guilty Except Insane

When someone is found "guilty except insane" in an Arizona criminal case, the judge does not send them to prison. Instead, the judge must send them to a secure mental health facility.

The process for this placement follows a separate Arizona law, A.R.S. § 13-3992, which sets out the specific steps for how that commitment works. The facility must be secure, meaning the person cannot simply leave on their own.
