Rule 8.6 Denial of Speedy Trial

When the court finds that your case took too long to go to trial, the charges against you must be dropped. This applies after the court has removed any time periods that don't count toward the deadline, such as delays caused by the defendant.

The court has two options when dismissing the case. It can dismiss "with prejudice," which means the charges are gone for good and cannot be filed again. It can also dismiss "without prejudice," which means the prosecutor could potentially refile the charges against you.
