Proceedings in the appellate division after certification or transfer
Transfer of Appellate Division Cases to the Court of Appeal
When the appellate division certifies a case for transfer or the Court of Appeal orders transfer, further action by the appellate division is limited to preparing and sending the record under rule 8.1007 until termination of the proceedings in the Court of Appeal.
Once a case gets transferred to the Court of Appeal, the appellate division steps back. Its only job at that point is to prepare and send the case records to the higher court.
The appellate division cannot take any other action on the case while the Court of Appeal is handling it. Everything stays on hold at the lower level until the Court of Appeal finishes its work.
