Rule 8.812 Relief from default

If you miss a deadline or fail to follow the rules in your appellate case, you can ask the court for relief. The presiding judge has the power to excuse your mistake if you have a good reason for it.

There is one exception: if you missed the deadline to file your notice of appeal, the court cannot help you. That deadline is firm, and no amount of good cause will fix it. Every other type of mistake or missed step can potentially be excused.
