Rule 8.930 Application

When someone wants to challenge a court decision through a special legal request called a "writ," there are specific rules that apply. A writ is a formal written order asking a higher court to review or correct something a lower court did. This chapter covers writs of mandate, certiorari, and prohibition, along with other writs that the appellate division has the power to hear. It also covers writs related to small claims court orders that deal with collecting money after a judgment.

However, this chapter does not cover every type of writ. Three types are excluded: requests to pause a case while an appeal is happening (called a writ of supersedeas), most writ requests related to small claims court decisions (except for post-judgment collection orders), and writs that the appellate division does not have the authority to handle. For anything this chapter does not spell out, the rules about brief writing found in rule 8.883 still apply.
