Court-Ordered Reference Under Code of Civil Procedure Section 639
Rule Text
A reference ordered under Code of Civil Procedure section 639 entitles the parties to the use of court facilities and court personnel to the extent provided in the order of reference. The proceedings may be held in a private facility, but, if so, the private facility must be open to the public as provided in rule 3.931.
Plain-English Summary (for reference only — not a substitute for the rule text above)
When a judge orders a reference (sending a case to a neutral person called a "referee" to handle certain issues), the parties can use the court's rooms and staff, but only as much as the judge's order allows.
The referee can also hold hearings at a private location instead of the courthouse. If that happens, the public must still be allowed to attend, just as they would be at a courthouse.
