When a judge decides not to officially recognize a fact as automatically true (called "judicial notice"), the judge must tell everyone in the case about that decision as soon as possible.

The judge also has to make sure that denial is recorded in the official court record. This way, all parties know where things stand and can plan how to prove that fact using other evidence if they need to.
