§ 125 [Definition of Conduct]

The word "conduct" in California evidence law covers a wide range of actions and behaviors. It is not limited to just physical actions or spoken words.

"Conduct" can include things you do, things you say, things you write, and even things you choose not to do. For example, staying silent when someone accuses you of something can count as conduct, just as much as speaking up or physically acting.

This matters in court because evidence about a person's conduct can be used to help prove what happened. Knowing that conduct includes both action and inaction helps people understand why their behavior, or lack of behavior, might come up during a case.
