§ 412 [Inference from Failure to Produce Stronger Evidence]

When someone in a court case could have brought in strong, clear evidence but instead brings in weak or vague evidence, the judge or jury should be suspicious of that choice.

The idea is simple: if you have better proof available, why wouldn't you use it? Choosing weaker evidence when stronger evidence exists raises a red flag. It suggests the stronger evidence might actually hurt your case, so you left it out on purpose.

This rule pushes people to bring their best available evidence to court. If they do not, the other side can point this out, and the judge or jury can take that into account when deciding how much to trust what was presented.
