§ 453 [Party Request for Mandatory Judicial Notice]

If you want a judge to accept certain facts as true without making you formally prove them in court, you can ask the judge to do this through "judicial notice." This rule says the judge must agree to your request if you follow two basic steps.

First, you have to let the other side know you're asking for this. You can do this in your written court papers or some other clear way, but you need to give them enough warning so they have a fair chance to respond or argue against it. Second, you have to give the judge enough details and information about the fact you want recognized. The judge can't just take your word for it. You need to show proof or a clear source that backs up what you're asking the court to accept.

If you do both of these things correctly, the judge does not have a choice in the matter. The law says the judge "shall" take judicial notice, meaning it becomes required rather than optional once you've met these two conditions.
