Rule 40 Assignment of Cases for Trial

This rule lets each trial court decide how to schedule cases for trial. Courts can set up their own system for organizing the trial calendar, as long as it follows any guidance from the Chief Justice of the Colorado Supreme Court.

The rule also says some cases must be scheduled ahead of others. If a case qualifies for priority handling (for example, under another law or rule that says it should move faster), the court needs to give it that priority when setting the trial calendar.

In short, this rule gives courts flexibility to manage their own scheduling, but it also makes sure cases that are legally entitled to go first actually get treated that way.
