Rule 52 Harmless Error and Plain Error

Not every mistake made during a criminal case is a big deal. If a court or the lawyers slip up in some small way, but that mistake doesn't actually hurt the defendant's rights or change the outcome of the case, judges are supposed to ignore it. This is called "harmless error." The idea is that criminal cases shouldn't be thrown out or retried over minor technical mistakes that don't really matter.

But there's an exception for serious mistakes. If something goes wrong during a trial that does hurt a person's basic rights, a judge can fix it later even if nobody complained about it at the time. Normally, if your lawyer doesn't object to a problem during the trial, you lose the chance to raise it later. This rule says that's not always true. If the mistake is bad enough, called "plain error," a higher court can still step in and correct it, even though no one spoke up in the moment.

In short, this rule tells judges to shrug off small errors that don't change anything, but pay attention to serious ones that could unfairly affect someone's case, even if those errors weren't caught right away.
