Rule 6.1 Subpoenas — Issuance and Time Limits

If you're asked to testify before a grand jury or bring documents (that's what "duces tecum" means), you have to get at least 48 hours notice before you're expected to show up. This gives you time to prepare, arrange your schedule, or talk to a lawyer if you need one.

There are two exceptions to this waiting period. First, you can agree to waive the 48-hour notice if you're willing to appear sooner. Second, a judge can shorten the notice period if there's a good reason to do so, even if you don't agree to it. This might happen if the case is urgent or evidence could be lost by waiting.
