Local Rule RULE 1009-1: AMENDMENTS

RULE 1009-1. AMENDMENTS
(a) A party filing a document amendingseeking to amend a voluntary petition, list, schedule, statement of financial affairs, statement of intention, or statement of current monthly income shall do so by notice as set forth in Fed. R. Bankr. P. 1009(a), except with respect to the following in an individual debtor's case:
(1) amendment to add a creditor; or
(2) amendment to the schedule of exemptions after the deadline for objecting to the exemptions.
(b) If either exception set forth in subsection (a) applies, the debtor shall file a motion to amend seeking approval of the amendment.
(a) (c) The following documents, to the extent applicable, shall be filed along with the documents required in subsections (a) and (b):
(b) (a) (1) the amended voluntary petition, list, schedule, statement of financial affairs, statement of intention, or statement of current monthly income, which shall clearly identify in the caption that the document is "amended," and comply with the notice provisions set forth in Fed. R. Bankr. P. state in the caption that the document is "amended"; 1009, except with respect to the following in an individual debtor's case: an amendment to add a creditor; or an amendment to the schedule of exemptions after the deadline for objecting to the exemptions has expired.
(b) If either exception set forth in subsection (a) applies, the debtor shall accompany the amendment with a motion seeking leave to amend. The motion to amend shall include a statement of the reason for the amendment and a summary of any change.
(c) The following documents, to the extent applicable, shall be filed along with the documents required in subsections (a) and (b):
(2) 1) Official Form 106106Dec - Declaration About an Individual Debtor's Schedules or Official Form 202202Dec - Declaration Under Penalty of Perjury On Behalf of a Corporation or Partnershipfor Non-Individual Debtors;
(3) 2) an amended summary of schedules, (Official Form B 106Sum entitled, "- A Summary of Your Assets and Liabilities and Certain Statistical Information" or Official Form 206Sum entitled, "- A Summary of Your Assets and Liabilities"); (nonindividuals)); and
(43) a certificate of service of notice to all parties in interest, including persons affected by the amendment.
(c) (d) (d) If the debtor is adding a creditor or is changing an existing creditor's address on the mailing matrix, the motion to amend or notice shall include a separate list of the names and addresses of only the added creditors in compliance withas prescribed by MLBR Official Local Form 1.
