Rule 2004-2. Filing Transcript of a Rule 2004 Examination. If a certified transcript of an examination under Fed.R.Bankr.P. 2004 is prepared, the certified transcript shall be electronically filed with the Court in compliance with Bankr. D.S.D. R. 5077-1(c)(1), regardless of whether any party intends to use the transcript during a hearing or trial.

Practice Pointer: A transcript of a Rule 2004 examination should be captioned for the main bankruptcy case and should be filed in the main bankruptcy case. A deposition transcript should be captioned for the adversary proceeding to which it relates and should be filed in that adversary proceeding. On the rare occasion a deposition is taken in connection with a pending contested matter, the deposition should be captioned for the main bankruptcy case and filed in the main bankruptcy case.
