RULE 1017-2 CONVERSION FROM CHAPTER 7 TO CHAPTER 13 A debtor who seeks to convert a chapter 7 case to a chapter 13 case must do so by motion. The debtor must assert facts that demonstrate eligibility for chapter 13 relief and that the conversion is sought in good faith. The motion must be served upon all creditors and parties in interest, the chapter 7 trustee, and the United States trustee. The debtor shall file a certificate of service.
Comment This motion may be pursued on a default basis under LBR 9013-3.
