1016-1 DEATH OF DEBTOR

(a) Statement of Death. If a debtor dies while the debtor's case is pending, debtor's counsel or the joint debtor shall file a statement advising the court of the debtor's death and date of death. Except as provided in (c) below, the filing of the Statement of Death does not abate any other obligations the debtor may have under the Code or Rules. Optional LBR Form 1016-1 is available in the Forms section of these Local Rules.

(b) Motion Waiving Certification Requirements. Except for the automatic waiver provided in (c) below, debtor's counsel or the joint debtor may file a motion to waive certification requirements necessary for discharge to the extent the requirements cannot be completed upon the debtor's death.

(c) Automatic Waiver of Financial Management Course. A motion seeking a waiver of the requirement to take a financial management course under §§ 727(a)(11) or 1328(g) of the Code is not required as long as a statement of death has been filed pursuant to subsection (a).
