Rules of Appellate Procedure and Internal Operating Procedures of the Eighth Circuit — Internal Operating Procedures: IV. Deciding the Appeal
The panel determines whether the opinion in the case is to be published or unpublished. Unpublished opinions may be cited only in accordance with FRAP 32.1 and 8th Cir. R. 32.1A. Counsel may request, by motion or letter to the clerk, that an unpublished opinion be published.
