Local Appellate Rules and Internal Operating Procedures of the Third Circuit — I.O.P. Chapter 16. Death Penalty Cases
If a stay application is filed in this court before a district court decision has been entered, the clerk shall forward the motion to a special panel. Whether or not a stay application has been filed, if no ruling has been made 10 calendar days before the time scheduled for execution of the judgment, the case shall tentatively be assigned to a panel, which will be kept advised of the status of the case, the name of the district judge before whom it is pending, and the scheduled time of execution of the judgment.
