DCt.LBR 8009-1 DISMISSAL OF APPEAL WHEN AN APPELLANT FAILS TIMELY TO FILE A RULE 8009 DESIGNATION OF RECORD OR STATEMENT OF ISSUES ON APPEAL If an appellant fails timely to designate items to be included in the record on appeal or to file a statement of the issues to be presented, an appellee may move the District Court to dismiss the appeal–or the District Court, after notice and reasonable opportunity to respond, may dismiss the appeal on its own motion.
