RULE 39.1 ORAL ARGUMENT AT JURY TRIALS At trial, the party having the burden of proof has the right to open and close the jury argument regardless of whether the defendant has offered evidence. If each of the parties has the burden of proof on one or more issues, the court will determine the order of arguments. The court may set time limitations on arguments. * * * As amended 3/04.
