Rule 5.1 Notice of Constitutional Question
(a) Cases that Challenge the Constitutionality of a Federal Statute In any case challenging the constitutionality of an Act of Congress that affects the public interest in which the United States and its representatives are not parties, the filing party must file a separate pleading with the Court captioned "Notice of Constitutional Question – Federal Statute." The notice must contain the title of the action, the docket number if any, and the Act of Congress in question.
(b) Cases that Challenge the Constitutionality of a State Statute In any case challenging the constitutionality of a state statute that affects the public interest in which the state and its representatives are not parties, the filing party must file a separate pleading with the Court captioned "Notice of Constitutional Question – State Statute." The notice must contain the title of the action, the docket number if any, and the state statute in question.
