4.1 Issuance and Service of Process The issuance and service of process must be in conformity with the Federal Rules of Civil Procedure. Only the clerk may issue process in all proceedings brought to quash an IRS summons. The clerk may sign, seal, and issue a summons in CM/ECF. The clerk will issue summons and/or subpoenas for plaintiffs proceeding under 28 U.S.C. § 1915 and 28 U.S.C. § 1915A only if directed to do so by the court.
