RULE 83I CERTIFICATES OF APPEALABILITY A petitioner wishing to appeal from the denial of a petition pursuant to 28 U.S.C. § 2254 or 28 U.S.C. § 2255, must timely file a notice of appeal and should promptly apply to the presiding judge for a certificate of appealability. The application will be directed in the first instance to the district judge who refused the petition.
