DUCivR 3-1 INITIATION OF A CIVIL ACTION AND PAYMENT OF THE FILING FEE
(a) Documents.
(1) Case-Initiating Document. A case may be initiated by filing a complaint or other case-initiating document with the court.
(2) Civil Cover Sheet. A Civil Cover Sheet, Form JS-44, must be filed with the complaint or case-initiating document. Information contained in the Civil Cover Sheet has no legal effect and is only used for administrative purposes.
(3) A Motion in a Case-Initiating Document. A motion cannot be included in a complaint, counterclaim, or crossclaim. Any motion (e.g., a motion for temporary restraining order) accompanying a complaint must be filed as a separate document.
(b) Filing.
(1) An attorney must initiate a case electronically in CM/ECF, except in a sealed case or where leave to file the case under seal is pending.
(2) An unrepresented party may initiate a case by sending the case-initiating document to the Clerk's Office in Salt Lake City at the Orrin G. Hatch Courthouse via email, mail, or hand-delivery.
(3) The filing date for a complaint and case-initiating document is the date it is received by the Clerk's Office, whether it is electronically filed in CM/ECF, emailed, mailed, or hand-delivered.
(c) Filing Fee.
The filing fee, as identified on the court's Miscellaneous Fee Schedule, should be paid at the time the complaint or case-initiating document is filed, except as provided in DUCivR 3-2. If the filing fee is not paid within 7 days, the Clerk will close the case.
(d) Electronic Filing System Downtime.
During system downtime or outage, a complaint or case-initiating document with a statute of limitations deadline will be accepted via email at utdecf_clerk@utd.uscourts.gov. The email should include notice of the system outage and the statute of limitations deadline.
