LR 39.4 Civil Trials, Order of Summation in Third-Party Action. In actions which involve a third-party action and if evidence has been presented by each party, the plaintiff's attorney shall first sum up as in Local Rule 39.3. Defendant's attorney shall next sum up for defendant as in Local Rule 39.3 and, for defendant as third-party plaintiff, shall state explicitly upon what he or she relies against the third-party defendant. The attorney for the third-party defendant shall next sum up as the nature of his or her third-party defense may require. The attorney for third-party plaintiff may then reply in rebuttal and thereafter the attorney for the original plaintiff may reply in rebuttal only of original defendant.
