B. Definition: The term "digital media exhibits" as used in this rule means files that are in an electronic audio and/or video format (.mp4, .mov, .mp3, .wav, etc.). Picture or text files (.jpeg, .png, .docx, .txt, etc.) are not considered digital media exhibits under this rule and are not to be submitted through the portal referenced in paragraph A of this rule. Such files are to be submitted through the court's case management system as a PDF.
C. Designation: For the purposes of this local rule, a digital media file must be classified at the time of filing or submission as one of the following:
1. Public Record: A digital media exhibit submitted to the Clerk's Office and available to the public when requested. A member of the public may place an order with the Clerk's Office to be provided with an electronic copy of the exhibit subject to payment of the appropriate fee set by the Judicial Conference of the United States.
2. Sealed: A digital media exhibit submitted to the Court under the procedures found in LR 5.8 and LR 26.2. An exhibit submitted under this designation will not be available to the public. The filing party must serve an unredacted copy of the exhibit on any other party, unless otherwise ordered.
3. Ex Parte: When Court ordered, a digital media exhibit submitted with this designation will only be available to the assigned judge. The public and other parties will not have access to this exhibit.
