81.3 Removed Cases, Demand for Jury Trial In an action removed from a state court, a party entitled to trial by jury under Fed. R. Civ. P. 38 shall be accorded a jury trial if the party files and serves a demand in accordance with the provisions of Fed. R. Civ. P. 81 and L.R. 38.1. The Court will not consider a motion that a party filed in state court unless that party refiles the motion in this Court in accordance with the Local Rules of Practice for the Northern District of New York.
