Criminal Rule 16.1.b Pleadings and Motions Before Trial Defenses and Objections Discovery Motions. All criminal discovery motions must be made to the assigned district judge. The district judge may refer a discovery motion to a magistrate judge for determination. A magistrate judge may hear motions to preserve evidence before a case is assigned to a district judge, and thereafter as requested by the assigned district judge. A magistrate judge may order discovery when necessarily incident to any hearing the judge is conducting.
