Local Rule 5.1-2 – Actions Seeking Nationwide or Statewide Relief
(a) Applicability. This Rule applies to any civil action filed by a party seeking to:
(1) bar or mandate statewide enforcement of a state law, including a rule, regulation, policy, or order of the executive branch or a state agency, whether by declaratory judgment and/or any form of injunctive relief; or
(2) bar or mandate nationwide enforcement of a federal law, including a rule, regulation, policy, or order of the executive branch or a federal agency, whether by declaratory judgment and/or any form of injunctive relief.
(b) Civil Cover Sheet. The party filing the case initiating document must include the following language in section VI. CAUSE OF ACTION on the JS-44 (Civil Cover Sheet):
"Seeking to [bar or mandate] [statewide or nationwide] enforcement of a [state or federal] law"
(c) Caption. The caption of any complaint or amended complaint for any case filed pursuant to subdivision (a) must include the following language immediately below the case number:
[NATIONWIDE] [STATEWIDE] RELIEF SOUGHT Note: Added April 15, 2024, to implement Judicial Conference policy recommending that cases seeking nationwide or statewide relief be assigned on a district-wide basis.
