LR9.1 Three Judge Cases Upon filing any suit or proceeding that is thought to require a three-judge court for its disposition, the party instituting the action must give notice to the clerk and other parties in writing, stating under what provision he/she is proceeding and that a three-judge court is requested. In the absence of such notice, the clerk may treat the matter as one not requiring three judges.
