Rule 26.3 Mistrial

When a judge is thinking about calling a mistrial, they must stop and give both sides a chance to speak up first. This means the prosecution and every defendant gets to say whether they agree with stopping the trial or whether they object to it.

Each side can also suggest other options besides a mistrial. The judge has to hear these comments before making a final decision. This gives everyone a fair say before the trial is potentially ended early.
