Rule 134.1 Business Trusts

Business trusts follow different rules than regular trusts in Delaware's Court of Chancery. If you are involved in a case about a business trust, the court will not apply the special trust and trustee rules found in Part XIII of the Court of Chancery rules.

This matters because business trusts are treated more like companies than like personal or family trusts. If your case involves a business trust, you should look to other rules that apply to business entities rather than the trust-specific rules in Part XIII.
